IN EXERCISE of the powers contained in section 54 of the Zambia Institute of Secretaries Act, 2022, the following Regulations are made:

1. Title

These Regulations may be cited as the Zambia Institute of Secretaries (Registration) Regulations, 2025.

2. Interpretation

In these Regulations, unless the context otherwise requires—Council” has the meaning assigned to the word in the Act;certificate of registration” has the meaning assigned to the words in the Act;Institute” has the meaning assigned to the word in the Act;practising certificate” has the meaning assigned to the words in the Act;professional secretary” has the meaning assigned to the words in the Act;register” has the meaning assigned to the word in the Act; andRegistrar” has the meaning assigned to the word in the Act.

3. Application for registration as professional secretary

(1)A person who intends to be registered as a professional secretary shall apply to the Institute for registration in Form I set out in the First Schedule on payment of a fee set out in the Second Schedule if the applicant possesses the qualification and experience set out in the Third Schedule.
(2)The Institute shall, where an application meets the requirements of the Act and these Regulations, issue a certificate of registration in Form II set out in the First Schedule.
(3)The Institute shall, where the Institute rejects an application under subregulation (1), inform the applicant in Form III set out in the First Schedule.

4. Qualification for registration

The Institute shall, in considering an application under regulation 3, take into account the qualifications set out in the Third Schedule.

5. Request for further information

The Institute may request for further information in respect of an application under regulation 3 in Form IV set out in the First Schedule.

6. Suspension and cancellation of registration

(1)The Institute shall, before suspending or cancelling the certificate of registration, notify the professional secretary of its intention to suspend or cancel the certificate of registration in Form V set out in the First Schedule.
(2)The Institute shall notify the professional secretary of the suspension or cancellation in Form VI set out in the First Schedule.

7. Application for practising certificate

(1)A registered professional secretary who intends to practice or be employed as a professional secretary shall apply to the Institute for a practising certificate in Form VII set out in the First Schedule on payment of a fee set out in the Second Schedule.
(2)The Institute shall, where the applicant meets the requirements of the Act and these Regulations, issue a practising certificate in Form VIII set out in the First Schedule.

8. Validity of practising certificate

A practising certificate issued under regulation 7 is valid for a period of one year ending on 31st December of each year.

9. Renewal of practising certificate

(1)A professional secretary issued with a practising certificate shall apply to the Institute for renewal of the practising certificate in Form VII set out in the First Schedule on payment of a fee set out in the Second Schedule.
(2)An application for renewal of a practising certificate under subregulation (1) shall be made at least thirty days before the expiry of the practising certificate.
(3)An application for renewal of a practising certificate that is made less than thirty days before the expiry of that practising certificate, or after the expiry of that practising certificate, shall attract a penalty fee set out in the Second Schedule.

10. Duplicate certificate of registration or practising certificate

(1)A professional secretary whose certificate of registration or practising certificate is lost or destroyed shall apply to the Institute for a duplicate certificate in Form IX set out in the First Schedule on payment of a fee set out in the Second Schedule.
(2)The Institute may, on receipt of an application under subregulation (1), and on payment of a fee, issue the applicant with a duplicate certificate of registration or practising certificate in Form II or Form VIII, respectively.

11. Suspension or cancellation of practising certificate

(1)The Institute shall, before suspending or cancelling a practising certificate inform the professional secretary of its intention to suspend or cancel the practising certificate in Form V set out in the First Schedule.
(2)The Institute may suspend or cancel the practising certificate of a professional secretary in Form VI set out in the First Schedule.

12. Surrender of practising certificate

A registered professional secretary who intends to discontinue or stop practising as a professional secretary shall notify the Institute in Form X set out in the First Schedule and immediately surrender the practising certificate to the Registrar.

13. Change in details

A registered professional secretary shall notify the Registrar of any change in details relating to the registration as a professional secretary in Form XI set out in the First Schedule.

14. Inspection of register

Members of the public may inspect the register on payment of a fee set out in the Second Schedule.

15. Appeal

A person who is aggrieved by the decision of the Council may appeal to the Minister in Form XII set out in the First Schedule.

16. Fees

The fees set out in the Second Schedule shall be payable in respect of the matters specified in that Schedule.
